Mitzie Lau – The Right of a Witness to Testify

When a witness can positively identify a person, they have the right to testify in court. For example, in a case involving Mitzie Lau, a witness might be able to positively identify a defendant when they have seen the defendant in close quarters during the commission of the crime. This is not always the case, however. The prosecution may have a photograph or other document of the defendant that proves he was able to make an in-court identification. The jury will be able determine the defendant based upon these facts, regardless of whether it is true or false.
